EAST WAVERTREE & CHILDWALL TENNIS SECTION RULES

 

RULES AS AT 6th February 2007

 

1) NAME AND OBJECTS

 

The section, founded in 1935 shall be named “The East Wavertree  & Childwall Community Association (Lawn Tennis Section) and shall for its objects the provision of lawn tennis, social and other facilities for its Members.

 

2)    CONSTITUTION

 

The Section is constituted by these Rules as a non profit-making Members’ Club. In no circumstances during the continuance of the Section, nor at nor after its dissolution, shall any assets or surplus funds be distributed to any Member or other person nor to any organisation which is not itself either constituted as non-profit making or a charity.

 

3)    AFFILIATION

 

The section shall seek affiliation to The Lawn Tennis Association through the appropriate county lawn tennis association and shall adopt and conform to the Rules of these organisations in so far as they can apply.

 

4) CLASSES OF MEMBER AND SUBSCRIPTION RATES

 

There shall be the following Classes of Member at the rates of subscription shown: -

 

a) ORDINARY MEMBER who shall be full playing members entitled to all the privileges of the Section and the right to vote at General Meetings - ANNUAL SUBSCRIPTION £50.00

 

b)    STUDENT MEMBER who shall be full playing members entitled to all the privileges of the Section and the right to vote at General Meetings. However the member must be attending a further education establishment on 1st April of the appropriate year. - ANNUAL SUBSCRIPTION £50.00

 

c) INTERMEDIATE MEMBERS who are members under the age of 18 years on 1st April of the appropriate year. They shall be entitled to attend but not vote at General Meetings. They may however elect from amongst themselves up to two additional members eligible to serve on the Management Committee if so elected. The two members have the right to vote as if they were Ordinary Members. The combined total of Ordinary, Student and Intermediate Members shall not exceed 22 per court. - ANNUAL SUBSCRIPTION £40.00

 

d)    JUNIOR MEMBERS who are members over the age of 7 years but under 16 years on 1st April of the appropriate year. They will be allowed to play on specified club courts during such periods of time and conditions as the Management Committee shall decide and shall be subject to such other restrictions as may from time to time be determined by the Management Committee. Junior Members are not eligible for election to the Management Committee or be entitled to vote at General Meetings. - ANNUAL SUBSCRIPTION £35.00

 

e)    COUNTRY MEMBERS - Members living further away than 30 miles from the club and they will not be entitled to vote at General Meetings of the Section or to serve on the Management Committee. - ANNUAL SUBSCRIPTION £50.00

 


f)     HONORARY MEMBERS who are persons no longer actively engaged in the playing of tennis and other persons at the discretion of the Management Committee who shall be considered worthy of Honorary Membership because of services to the game of lawn tennis and/or East Wavertree Lawn Tennis Section. The total number of Honorary Members shall not exceed six but may be amended as and when considered in the interests of the section in conjunction with discussions between the Management Committee and the Association Council. Honorary Members shall not be liable for a subscription but will be entitled to full voting rights and eligible to serve on the Management Committee.

 

Notes to the Subscription Scale

 

               I.      The subscription year runs from 1st April to 31st March

 

             II.      A renewal Ordinary Member whose subscription is not paid by 30th April will not be entitled to the privileges of membership until the subscription is paid. Furthermore, the member must pay a £10.00 penalty charge in addition to the membership subscription.

 

            III.      Family Discount is allowed for juniors and intermediates and they shall not be liable for a subscription. Family Discount Qualification consists of 2 seniors and at least one junior or intermediate all living at the same address.

 

          IV.      For a new member after the end of 30th June, 30th September and 31st December, the Committee may at their discretion accept a proportionately reduced subscription for the part-year. Similarly, they may make a refund to a member who becomes unable to use the club for a substantial part of the year on account of injury, illness or departure from the region.

 

            V.      A £5.00 Junior Discount is allowed for Juniors who are members under the age of 11 on 1st April of the appropriate year.

 

          VI.      A £40.00 Discount is allowed for Ordinary Members who are under the age of 21 on 1st April of the appropriate year.

 

5)    ACCOUNTANCY YEAR

 

Except for the purposes of subscriptions (see Rule 4, Note 1), the Section’s Financial Year shall run from 1st January to 31st December and the accounts submitted to the Annual General Meeting shall be prepared accordingly.

 

6)    MEMBERSHIP

 

Honorary Membership shall be strictly limited and at the discretion of the Committee, by way of reward for special services to the Section. For the other classes of Membership provided in Rule 4, a candidate may join the Section by completing an application form and forwarding it with the annual subscription to either the Treasurer or Secretary. Junior subscriptions must be paid before the Member first plays. The Committee have the right to consider every application before acceptance of a candidate. If accepted, then a shoe tag will be despatched within 28 days.  The Committee also have the power to limit the numbers of Members in the respective Classes if they consider this necessary.

 

7)    RESIGNATION AND TRANSFER BETWEEN CLASSES

 

Member wishing to withdraw from membership or to transfer to a Class at a lower rate of subscription shall notify the Secretary in writing.

 


8)    SUSPENSION OR EXPULSION

 

The Committee shall have power to terminate or suspend the membership of any Member or to exclude any Member or Guest whom it considers guilty of a breach of these Rules or of misconduct or offensive behaviour to any other Member, Guest or Employee, whether on the premises or elsewhere. Before a Member is expelled, the Secretary shall give the Member seven days written notice to attend a meeting of the Committee which notice shall contain particulars of the complaint. No Member shall be expelled without first having an opportunity of appearing before the Committee and answering the complaint made, nor unless at least 2/3 of the Committee then present vote in favour of the Members expulsion.

 

9)    INJURY, LOSS OF PROPERTY ETC.

 

Members or Guests leaving unattended vehicles, rackets, clothing or other property on the premises do so at their own risk and the Section shall not be responsible for any loss, damage or injury resulting from this or any other cause.

 

10) GUESTS AND TEMPORARY MEMBERS

 

Guests may be introduced by any Member. Before a Guest plays, the Member introducing the Guest must pay the appropriate fee to the Treasurer or any other Committee Member.

 

AGE (18 AND OVER)          £5.00 PER DAY

AGE (UNDER 18)                £3.00 PER DAY

 

A Guest may not play more than three times in any year except with the special permission of the Committee. A Guest is not allowed to play whilst Members are waiting.

 

Every member of a visiting match team shall be a Temporary Member for the day and every competitor in a tournament on the premises shall be a Temporary Member for the period of the tournament.

 

11) MANAGEMENT

 

The management of the Section shall be in the entire control of a Committee of members consisting of 7 Officers, who shall be a Chairman, Vice-Chairman, Secretary, Treasurer, Club Captain, Men’s Captain and Ladies’ Captain. The total number of the Committee shall not exceed 12. If more than one of the offices are held by a single person, no extra Committee vacancy shall be thereby created. All shall be elected for the year at the annual general meeting except the elected Committee shall have the power to fill any casual vacancy. There shall be a minimum of three ladies or three men on the Committee providing not less than this number accept nomination. The Committee shall elect Members in accordance with Rule 6 and shall from time to time make and revise the Section’s Regulations and shall have power to decide any matter not provided for by these Rules and the current Regulations. They shall meet at least four times in every year and additionally as circumstances may require. The quorum at a Committee Meeting shall be four and in the event of equality of voting the Chairman shall have a casting vote. The Committee may delegate any part of its duties (except the election of Members) to one or more sub-committees which may be composed of any Members of the Section. The licensee is automatically delegated the legal responsibilities of controlling the bar supplying intoxicating liquor and can attend the Committee when required.

 

Executive Officers of the Association are entitled to vote at general meetings and Committee meetings as per The Articles of Association.

 


12) GENERAL MEETING

 

An annual general meeting shall be held each year between 1st February and the 28th February inclusive.

 

The Committee shall call an extraordinary general meeting at their discretion or within one month of receipt by the Secretary of a requisition signed by 20 Members or, if the total Ordinary Membership is less than 100, by 1/5 of the members, stating the business proposed to be transacted.

 

Any member wishing to propose a resolution at the annual general meeting must send a copy to the Secretary before 31st December, prior to the AGM, so that provision may be made on the Agenda. The Secretary shall send to every member at least 14 days’ notice of any general meeting, together with a copy of the Agenda.

 

The business of the annual general meeting shall be the confirmation of the minutes of the previous annual general meeting and of any subsequent extraordinary general meetings, the consideration of the Chairman’s report and the Treasurer’s Accounts for the year, the election of Officers and Committee for the ensuing year and any items of which notice has been given and details included in the Agenda. The business of an extraordinary general meeting shall be in accordance with the requisition under which it was summoned and the Agenda issued. At any general meeting further business may be accepted at the discretion of the Chairman provided that it does not call for an alteration of Rules, the winding up of the Section, the transfer of any of the section’s assets, the borrowing of money, or any expenditure not within the immediate financial resources of the Section. Every Member (other than Temporary Members) shall be entitled to be present and to speak at any general meeting, but only Ordinary, Student and Honorary Members are allowed to vote. In event of an equality of votes, the Chairman shall have a casting vote.

 

At any general meeting, the quorum shall be 20 Members entitled to vote or, if the total Membership entitled to vote is less than 100, 1/5 of the members are deemed acceptable.

 

13) RULES AND REGULATIONS

 

A copy of these Rules and of the Regulations made by the Committee under Rule 11 shall be prominently displayed at all times on the notice board in the Clubhouse and all Members shall be deemed conversant therewith. The Rules shall not be altered except at a general meeting after due notice, and then only provided that 2/3 of those present and voting are in favour. All Rules must be confirmed by the Council of the East Wavertree and Childwall Community Association.

 

The Regulations shall be made and periodically revised by the Committee.

 

14) DISSOLUTION

 

The section shall be dissolved on the passing of a resolution to that effect at a general meeting after due notice, by at least 2/3 of those present and voting. Such a meeting shall appoint a committee to wind up the affairs of the Section and give general directions as to the disposal of any assets, within the scope of Rule 2.
